TERMS OF SERVICE

Overview

Welcome to JC Rugs. In these terms, "we", "us" and "our" mean JC Rugs Ltd, trading as JC Rugs. We operate jcrugs.co.uk and sell our rugs through it (the "Services"). Our store is powered by Shopify, but when you buy from us, your contract is with JC Rugs Ltd.

These Terms of Service apply alongside our Privacy Policy and Refund Policy, both linked at the bottom of every page of our website. Together they set out your rights and responsibilities when you use our website or buy from us. Please read them before placing an order. Nothing in these terms affects your statutory rights as a consumer under UK law.

Section 1: About us

JC Rugs Ltd is a private limited company registered in England and Wales under company number 17378893. Our registered office is Abacus House, Pennine Business Park, Longbow Close, Huddersfield, HD2 1GQ, United Kingdom.

Section 2: Using our website

You must be 18 or over to place an order. You agree that the information you give us, such as your name, address, email and payment details, is accurate and up to date. You're responsible for keeping any account login details secure.

Section 3: Our rugs

Made in Britain. All JC Rugs rugs are made in Britain. We sell two ranges:

  • our wool rugs
  • our Easy Care range, made from synthetic fibres (polypropylene or polyester)

Each product listing states what the rug is made from.

One of each. Most of our rugs are one-offs. When a rug has sold, it's gone, and we can't guarantee we'll make another the same.

Natural variation. Every rug is finished in-house, so small variations in size, shape, pile and pattern are part of the character of each piece. Stated sizes are approximate and may vary slightly. We photograph every rug as accurately as we can, but colours can look different depending on your screen and lighting.

Wool. New wool rugs naturally shed loose fibres for the first few weeks. This is normal and settles with regular vacuuming.

Care. Please follow the care guidance supplied with your rug or shown on our website. Damage caused by misuse, incorrect cleaning, pets, or normal wear and tear is not a fault with the rug.

Section 4: Drops and orders

Weekly drops. New rugs are released in scheduled drops. Stock is limited and sold on a first-come, first-served basis. Adding a rug to your basket does not reserve it. The rug belongs to whoever completes checkout first.

How the contract is formed. When you place an order, you're making an offer to buy. The confirmation email you receive after checkout confirms we've received your order. Our acceptance, and the contract between us, is formed when we email you to say your rug has been dispatched.

If we can't fulfil an order. Occasionally, during a busy drop, two customers may manage to pay for the same one-off rug, or a listing may contain an obvious error in price or description. If that happens, we'll contact you as soon as possible and refund you in full. We may also limit how many rugs one customer can buy in a single drop.

Personal use. Our website is for customers buying for their own homes. If you're a trade or business customer, please contact us before ordering.

Section 5: Prices and payment

All prices are in pounds sterling (£). JC Rugs Ltd is not currently VAT registered, so no VAT is charged. Delivery charges, if any, are shown at checkout before you pay. The price you pay is the price shown when you place your order.

Promotions and discount codes may have their own terms. Where they do, those terms apply alongside these.

Payment is taken when you place your order and is processed securely through Shopify. We never see or store your full card details. If we don't accept your order, you'll be refunded in full.

Section 6: Delivery

We deliver anywhere in the United Kingdom, including Northern Ireland. Estimated delivery times are shown at checkout or on our website. Unless we agree otherwise, we'll deliver your order within 30 days of you placing it.

The rug becomes your responsibility once it has been delivered to you, or to someone you've nominated to receive it. Ownership passes to you once we've received full payment.

If your rug arrives damaged, please email us photos at direct@jcrugs.co.uk as soon as possible, ideally within 48 hours. This helps us sort it out quickly with the courier. It does not affect your legal rights.

Section 7: Cancellations and returns

As a UK consumer buying online, you have the right to cancel your order within 14 days of the day you receive your rug, without giving a reason. To cancel, email us at direct@jcrugs.co.uk. Our Refund Policy explains how to return your rug and who pays the return delivery cost.

We'll refund the price of the rug and the original standard delivery charge within 14 days of receiving the rug back, or of you providing proof that you've sent it back, whichever is sooner. Rugs must be returned in the condition you received them. If a returned rug has been used or handled beyond what's needed to inspect it, we may reduce your refund to reflect the loss in value.

If your rug is faulty or not as described, you have additional rights under the Consumer Rights Act 2015, and we'll repair, replace or refund it in line with the law.

Section 8: Intellectual property

Everything on our website and social channels belongs to JC Rugs Ltd or is used with permission. That includes:

  • our name and logo
  • our photographs and videos
  • our rug designs
  • our text and branding

You may not copy, reproduce, or use any of it for commercial purposes without our written permission.

Section 9: Reviews, photos and feedback

If you send us reviews, photos, videos or feedback, or agree when we ask to share content you've tagged us in, you give us permission to use that content on our website, social media and marketing, free of charge. We'll credit you where possible, and we'll remove it if you ask us to. Please only share content you own and that doesn't show other people without their permission. Where we have a separate written agreement with you, for example a collaboration, that agreement applies instead.

Section 10: Third-party services

Our website uses services run by other companies, such as payment providers, couriers and social media platforms. We're not responsible for their content or terms, so please check their policies before using them.

Section 11: Relationship with Shopify

JC Rugs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with JC Rugs Ltd. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and JC Rugs Ltd, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with JC Rugs Ltd.

Section 12: Privacy

We handle your personal information in line with UK data protection law (the UK GDPR and the Data Protection Act 2018) and our Privacy Policy. Because our store runs on Shopify, some of your information is processed by Shopify and its service providers so that we can take and deliver your order.

Section 13: Errors on the website

We work hard to keep our listings accurate, but mistakes can happen in descriptions, prices, sizes or availability. If we find an error affecting your order, we'll contact you and let you choose whether to continue or cancel for a full refund.

Section 14: Prohibited use

You must not use our website for anything unlawful or harmful. This includes:

  • sending spam or malicious code
  • copying our content or designs
  • phishing, scamming, or pretending to be JC Rugs or anyone else
  • trying to get around our security measures
  • using bots or automated tools to buy stock during drops

We may cancel orders placed, or close accounts used, in breach of these terms.

Section 15: Agents

15.1 This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

15.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 15.4 below. In addition, no Agent may access, use, or interact with the Services if we have requested that the Agent refrain from doing so.

15.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.

15.4 Agents must:
(i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including "Agent/[agent name]" in the request's user agent string;
(ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by mimicking human behaviour and interaction patterns, or by completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans;
(iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer;
(iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

Section 16: Our liability to you

If we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We're not responsible for loss or damage that wasn't foreseeable. We only supply our rugs for domestic and private use, so we're not liable for any business losses.

Nothing in these terms limits or excludes our liability for any of the following:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • breach of your statutory rights as a consumer, including your right to goods that are as described, fit for purpose and of satisfactory quality

Section 17: Events outside our control

We're not responsible for delays or failures caused by events outside our reasonable control, such as courier disruption, severe weather or supplier issues. If this affects your order, we'll let you know, and you can cancel for a full refund.

Section 18: General

If any part of these terms is found to be unenforceable, the rest will still apply. If we don't enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms without our consent. We may transfer ours to another business, but this won't reduce your rights.

Section 19: Governing law

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

Section 20: Changes to these terms

We may update these terms from time to time. The version on our website when you place your order is the one that applies to that order.
